This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. Getting this visa is the first step towards a permanent Partner visa (Subclass 801)
Depending on where you apply from, partner visas can be applied either from onshore or offshore.

  • For onshore applicants- Temporary Partner Visa (Subclass 820) + Permanent Partner Visa (Subclass 801)
  • For offshore applicants- Partner (Provisional) visa (Subclass 309) + Permanent Partner visa (Subclass 100)

Eligibility:

  • Be in a genuine relationship with your spouse or de facto partner who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen
  • Be in Australia when you apply for this visa and when we decide your temporary visa application. Family who applies with you must also be in Australia

With this visa you can:

  • Live, work and study in Australia while we process your permanent Partner visa
  • Travel to and from Australia as many times as you want
  • Attend free English language classes provided by the Adult Migrant English Program

First, you will be given the Temporary Partner visa (subclass 820 or 309); allowing you to stay in Australia while the Permanent Partner visa (subclass 801 or 100) is processed. To get the Permanent Partner visa:

  1. Both stages of the visas are applied at the same time.
  2. Upon getting the temporary visa, you will be eligible for the Permanent Partner visa (subclass 801 or subclass 100) assessment roughly two years after initial application submission.
